However, the use of campaign materials after the conclusion of an official sponsorship term is governed by strict media policies to protect brand equity, intellectual property, and narrative consistency.
- Permitted Legacy Use (Non-Commercial): Sponsors and partners may continue to reference their previous involvement with KDV ENT 901 for brand legacy purposes, including:
- Use of previously approved campaign screenshots, highlight videos, press clippings, and social posts
- Public testimonials and brand case studies
- Portfolio inclusions, speaking engagements, and investor decks
Conditions:
- The sponsor must clearly indicate that the relationship is historic, not current (e.g., “Past Partner of KDV ENT 901”)
- No edits, remixes, or derivative content may be created from original media
- All reposts or uses must link to or credit the original campaign source
- Commercial Reuse Is Prohibited Without Authorization: Legacy partners may not engage in any of the following without express written approval:
- License, resell, or republish any campaign footage, music, racing content, or media assets
- Re-edit campaign materials for new marketing initiatives
- Use KDV ENT 901 likeness, trademarks, or personalities in unrelated ads or content
- Claim active endorsement or affiliation post-campaign
- Intellectual Property Retention: All music, visuals, campaign designs, footage, logos, and media created under KDV ENT 901 remain the intellectual property of KDV ENT 901 LLC in perpetuity. This includes, but is not limited to:
- Reality show footage
- Behind-the-scenes documentaries
- Mixtape visuals and audio content
- Race-day footage and media clips
- Sponsor-branded content created within the official campaign period
- Breach of Policy Consequences: Improper or unauthorized use of media post-campaign may result in:
- Formal legal notices and takedown demands
- Termination of legacy partner acknowledgment
- Public disassociation and potential disclosure of misuse
- Monetary penalties and legal damages under IP and publicity laws
- Duration of Restrictions: This policy remains in force for ten (10) years after the end of the campaign in which a sponsor or partner was active, unless otherwise extended or amended via contract.
- Legal Jurisdiction: All legal disputes related to post-campaign media use will be resolved under the jurisdiction of Shelby County, Tennessee.
